Personal Injury and Wrongful Death

Personal Injury is a broad term which refers to the types of lawsuits that arise when people are injured through the intentional or careless (negligent) acts of another person.   Personal injury claims arise from automobile crashes and other accidents where the defendant fails to exercise reasonable care.
 
When the person who caused the accident is determined to have failed to exercise reasonable care, he or she is liable and must compensate the injured person for damages, which may include past and future medical expenses, lost wages, pain and suffering, mental anguish, disfigurement, scarring, aggravation of a pre-existing condition, and loss of enjoyment of life.  Additionally, in some cases, the responsible party may even be liable for punitive damages, which are meant to punish the wrongdoer.

Accidents: 
Motor vehicle accidents are often traumatic and can change the lives of those involved. The injuries caused in such accidents can be serious and permanent and include neck and back injuries, broken bones, paralysis, amputations, head injuries, brain damage, disfiguring scars, burns, crushed or broken bones, and possibly death.  Pedestrians and bicyclists are in an especially vulnerable position on the road. Their safety depends on motorists’ exercise of reasonable care and caution. Injuries suffered by pedestrians and bicyclists are often severe, heal slowly, cause loss of income and outrageous medical bills.
 
Slip & Fall:
Slip (or trip) and fall accidents are caused by a dangerous or hazardous condition on someone else’s property.  This type of accident occur in shopping malls, grocery stores, restaurants and office buildings to name a few, and can also occur inside of a person’s residence. The law requires that property owners use reasonable care in the management and maintenance of their premises and avoid exposing others to an unreasonable risk of harm, such as a slip and fall or a trip and fall.  Property owners have a duty to inspect for any unsafe conditions on their premises and either repair or give adequate warning of conditions that pose a risk of harm to others. 
 
Wrongful Death:
Losing a loved one is never easy.  It is even harder when the death is caused by the carelessness or negligence of another.  A wrongful death claim is brought on behalf of a decedent’s estate and survivors for damages resulting from the careless conduct that caused the death.  We strive to recover damages that may be recovered because of the death, including the value of lost support and service, lost companionship, each survivor’s mental pain and suffering, each survivor’s loss of the amount of the decedent’s probable net income available for distribution, and medical and funeral expenses.
